Pedestrian Accident Claims

A pedestrian has no protection at all, so the injuries in these cases tend to be serious: fractures, head injuries, and the kind of soft-tissue damage that takes a year to settle. The claims are also more likely to be fought, because insurers routinely argue that the pedestrian stepped out.

That argument can usually be answered with evidence: CCTV, dashcam footage, the police collision report, and the physical evidence at the scene. The difficulty is that most of it disappears within weeks. The single most useful thing you can do is tell us early so we can go and get it.

Even where a pedestrian is found partly responsible, the claim does not fail. It is reduced by a percentage. Being told you were partly at fault is not a reason to walk away.
