Head injuries are the ones most often under-settled, because the effects that matter most do not show up on a scan.

The lasting consequences of a brain injury are usually cognitive and behavioural rather than physical: fatigue, irritability, memory and concentration problems, loss of initiative, a personality that the family says is not quite the same. None of that appears on imaging, and much of it is invisible in a twenty-minute medical appointment.

Proving it requires neuropsychological testing and, just as importantly, evidence from the people who live and work with the injured person. Family and colleagues frequently describe changes the injured person genuinely cannot see in themselves.

Even a “mild” traumatic brain injury can end a career. These claims should be built slowly, with the right experts, and never settled on an early offer.

Time limits Three years is the general rule, but where a brain injury has affected the injured person's capacity to manage their own affairs, the limitation period may not run at all. This is one of the areas where an assumption about being "too late" is most often wrong.
