These cases should never be rushed to settlement. A serious injury claim settled before the long-term prognosis is understood cannot be reopened, whatever happens afterwards.

Time limits The ordinary three-year limit applies, but there are important exceptions. Where an injured person lacks the mental capacity to conduct their own affairs, time does not begin to run while that continues. Where an injury has proved fatal, the three years generally run from the date of death. Take advice. Do not assume a claim is out of time.
